Man stood by as girlfriend raped by friend in Austria

The 46-year-old man had invited his 44-year-old girlfriend and his 53-year-old best friend to a drinking session at his new flat around last Christmas in the city of Eisenstadt, in eastern Austria.

After they got drunk, the man had reportedly gone next door with his girlfriend to make love, and when he had finished his friend had then gone into the bedroom where she had stayed and had raped her.

The court heard that DNA tests confirmed that the 53-year-old had had sex with the woman.

She told the court she made it clear that she did not want to have sex with the 53-year-old man saying: "I screamed 'leave me alone'."

But instead of helping her, she said her boyfriend who was standing nearby told her: "Shut your mouth, you idiot."

In court, the 46-year-old denied noticing that his girlfriend was being attacked and said: "If I had seen that he was having sex with my girlfriend, I would have thrown him out the flat."

When asked by the court why his girlfriend brought charges against him, he claimed she was trying to extort money out of him.

His 53-year-old best friend - who said he was "paralytic" from drinking - claims he does not remember what happened, although nevertheless telling the court: "But I feel guilty."

He was also found guilty of rape by the court and sentenced to two years, seven months of which he must serve behind bars.

The boyfriend received a four months suspended sentence for failing to provide help to the victim. The sentences are not yet legally binding.

Both defendants have paid compensation money to the victim, with the 53-year-old paying €3,000 and the 46-year-old paying about €500.
